1. Acceptance of Terms

By using our website or purchasing products, you agree to be bound by these Terms and Conditions and all applicable laws and regulations of England and Wales.

These terms form a legally binding agreement between you and Benjamin Alexander James Chaunavel trading as Momentary.

2. Use of Website

You may use our website for legitimate purposes such as browsing, purchasing, and contacting support.

Unauthorised use, including unlawful activity or system interference, is strictly prohibited.

3. User Accounts and Registration

You are responsible for maintaining your account credentials and ensuring all provided information is accurate.

You must notify us immediately of any unauthorised account activity.

4. Products and Pricing

All products are subject to availability. Prices may change without notice but will not affect orders already confirmed.

All prices displayed on our website include VAT at the applicable rate. There are no hidden charges. In accordance with the Digital Markets, Competition and Consumers Act 2024, the total price you pay (including VAT and any delivery charges) is shown clearly before you complete your order.

Whilst we strive for accuracy, we do not guarantee that product descriptions are entirely error-free. If you believe a product has been misdescribed, please contact us.

5. Orders and Payment

Orders may be accepted or rejected at our discretion. Payment must be completed before despatch.

We use secure, PCI-compliant systems to process payments. We accept major debit and credit cards, PayPal, and other payment methods displayed at checkout.

6. Shipping and Delivery

We despatch orders within 1–2 business days. Delivery times to UK mainland addresses typically range from 2–4 business days depending on the carrier and service selected.

Deliveries to the Scottish Highlands, Northern Ireland, and offshore islands may incur additional charges and longer delivery times.

Risk of loss and damage transfers to you upon delivery.

7. Your Statutory Rights: Cooling-Off Period and Faulty Goods

14-Day Cooling-Off Period (Consumer Contracts Regulations 2013): You have the right to cancel your order for any reason within 14 days from the day after you receive the goods. You must notify us of your decision to cancel and return the goods within a further 14 days. You are responsible for the direct cost of returning the goods unless the item is faulty or misdescribed.

30-Day Right to Reject (Consumer Rights Act 2015): If the goods are faulty, not as described, or not fit for purpose, you have the right to reject them and receive a full refund within 30 days of receipt. After 30 days, you are entitled to a repair or replacement, and if that fails, a price reduction or final right to reject. We will cover the cost of return postage for faulty or misdescribed items.

Refunds are processed within 14 days of our receipt of the returned goods (or proof of return) using the same payment method you used for the original purchase.

Certain goods are excluded from the cooling-off period, including personalised items, sealed goods opened for hygiene reasons, and perishable products.

8. Limitation of Liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.

Subject to the above, our liability for any claim arising from defective products is limited to the purchase price of the product. We are not responsible for indirect or consequential losses such as loss of profits, business interruption, or loss of data.

Your statutory rights under the Consumer Rights Act 2015 are not affected by this clause.

9. Privacy and Data Protection

Your personal data is processed in accordance with our Privacy Policy, the UK General Data Protection Regulation (UK GDPR), and the Data Protection Act 2018.

The Information Commissioner's Office (ICO) is the supervisory authority for data protection in the United Kingdom. You have the right to lodge a complaint with the ICO at ico.org.uk if you believe your data has been mishandled.

10. Intellectual Property

All website content, including text, images, logos, and design, is owned by or licensed to Momentary and is protected by copyright, trade mark, and other intellectual property laws.

You may not reproduce, distribute, or create derivative works from our content without our express written permission.

11. Governing Law and Disputes

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are not satisfied with our service, please contact us first. If we are unable to resolve your complaint, you may refer the matter to an alternative dispute resolution provider or to your local Trading Standards office. You may also seek advice from Citizens Advice at citizensadvice.org.uk or by calling 0808 223 1133.

12. Modifications to Terms

We may update these terms from time to time. Any changes will be posted on this page with a revised date. Continued use of the website after changes have been made constitutes acceptance of the updated terms.

13. Severability and Entire Agreement

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.

These terms, together with our Privacy Policy and Returns Policy, constitute the entire agreement between you and Momentary.
